Terms of Use
The plain-English rules for using Ember and this website during early access.
1. Who these terms are between
These terms are an agreement between you and Wellnetix Ltd, United Kingdom ("Wellnetix", "we"), covering the Ember mobile app and the ember.wellnetixltd.com website. By using either, you agree to them.
2. Ember is in early access
Ember is not yet publicly released. Early-access invitations are personal, may be limited in number, and may involve features that change, break, or are withdrawn as we learn. We may pause or end the early-access programme at any time. Where paid options exist later, separate purchase terms will be presented to you before you are charged anything.
3. You must be 18 or over
Ember is for adults. You confirm you are at least 18 when you create a profile or join early access. Ember is not directed at children and must not be given to a minor to use.
4. Ember is not a medical service
Ember is a non-clinical wellbeing companion. It does not provide medical advice, diagnosis, or treatment; it is not a medical device; and it is not a substitute for professional care. It deliberately declines to advise on HRT or medication and instead signposts you to qualified professionals. Never delay or disregard professional medical advice because of anything Ember says. 5. Your content stays yours
Everything you write or say to Ember remains yours. It is stored on your device, encrypted under your key; we claim no ownership and, by design, no access. You are responsible for keeping your device, passcode, and recovery kit safe — if you lose your key, we cannot recover your content because we never had it.
6. Acceptable use
- Don't use Ember or this site unlawfully, or to harm, harass, or deceive others.
- Don't attempt to break, probe, or overload our systems, or to extract or reverse-engineer the app or its models except where the law expressly permits.
- Don't resell, sublicense, or share early-access builds or invitations without our written consent.
7. Our stuff
The Ember and Wellnetix names, the First Light ring mark, the app, this site, and their content are owned by Wellnetix Ltd or its licensors and protected by intellectual-property law. We give you a personal, non-exclusive, non-transferable licence to use the app and site for their intended purpose — nothing more is granted.
8. What we don't promise
Early-access software is provided "as is" and "as available". To the fullest extent the law allows, we exclude implied warranties and don't promise the app or site will be uninterrupted, error-free, or fit for a particular purpose. Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or fraud — and nothing affects your statutory consumer rights.
9. Our liability
To the extent permitted by law, our total liability arising out of the app or site is limited to the amount you have paid us for them in the 12 months before the claim (or £50 if you have paid nothing). We are not liable for losses that are not reasonably foreseeable, or that result from events beyond our reasonable control.
10. Ending things
You can stop using Ember at any time and erase your data in the app. We may suspend or end your access if you seriously or repeatedly break these terms, or if we discontinue the service — where reasonably possible we'll give you notice so you can export your content.
11. Changes
We may update these terms as Ember evolves. For material changes we'll give notice in the app or by email before they take effect; continuing to use Ember after that means you accept the updated terms.
12. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that if you live elsewhere in the UK or in the EU, you keep any mandatory consumer protections and court rights of your home country.
